Regulamin Sklepu Internetowego KAPTURE.PL

§ 1 Postanowienia ogólne

  1. Niniejszy regulamin określa zasady korzystania ze sklepu internetowego dostępnego pod adresem www.kapture.pl, który jest prowadzony przez Hubert Dziurzyński KAPTURE.PL, prowadzącego jednoosobową działalność gospodarczą, wpisaną do Centralnej Ewidencji i Informacji o Działalności Gospodarczej, z siedzibą pod adresem: Gabrieli Zapolskiej 10B, 30-126 Kraków, posiadającą numer NIP: 8691576071 oraz REGON: 122590346.
  2. Sklep internetowy KAPTURE.PL działa na zasadach określonych w niniejszym regulaminie oraz zgodnie z przepisami obowiązującego prawa, w tym w szczególności z ustawą z dnia 30 maja 2014 r. o prawach konsumenta (Dz.U. z 2014 r., poz. 827, z późn. zm.) oraz ustawą z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną (Dz.U. z 2002 r., nr 144, poz. 1204, z późn. zm.).
  3. W celu skorzystania ze sklepu internetowego KAPTURE.PL, niezbędne jest posiadanie dostępu do Internetu oraz urządzenia z przeglądarką internetową umożliwiającą wyświetlanie stron internetowych. Klient zobowiązany jest do korzystania ze sklepu internetowego zgodnie z przepisami prawa oraz postanowieniami niniejszego regulaminu.
  4. Sklep internetowy świadczy usługi w zakresie sprzedaży detalicznej produktów dostępnych na stronie www.kapture.pl. Wszelkie informacje dotyczące produktów, w tym w szczególności ich opisy oraz ceny, mają charakter wiążący od momentu złożenia zamówienia przez klienta.

§ 2 Składanie zamówień i realizacja

  1. Zamówienia w sklepie internetowym KAPTURE.PL mogą być składane 24 godziny na dobę, przez 7 dni w tygodniu, za pośrednictwem formularza dostępnego na stronie internetowej.
  2. Klient dokonujący zakupu w sklepie internetowym KAPTURE.PL zobowiązany jest do podania prawidłowych danych niezbędnych do realizacji zamówienia, w tym w szczególności: imienia i nazwiska, adresu dostawy, adresu e-mail oraz numeru telefonu kontaktowego.
  3. Po złożeniu zamówienia przez klienta, sklep internetowy KAPTURE.PL potwierdza jego przyjęcie poprzez wysłanie wiadomości e-mail na adres podany przez klienta w formularzu zamówienia.
  4. Sklep internetowy KAPTURE.PL zastrzega sobie prawo do odmowy realizacji zamówienia w przypadku podania nieprawidłowych danych przez klienta, braku możliwości kontaktu z klientem, a także w innych przypadkach wynikających z przepisów prawa.

§ 3 Metody płatności i dostawa

  1. Sklep internetowy KAPTURE.PL umożliwia dokonywanie płatności za zamówione produkty za pomocą systemów płatności elektronicznych, takich jak Przelewy24 oraz PayPal.
  2. Zamówione produkty są dostarczane na terytorium Rzeczypospolitej Polskiej za pośrednictwem firm kurierskich, takich jak InPost. Istnieje również możliwość odbioru osobistego zamówionych produktów w siedzibie firmy.
  3. Koszty dostawy są doliczane do ceny zamówienia zgodnie z cennikiem dostępnym na stronie internetowej sklepu i są ponoszone przez klienta.

§ 4 Prawo odstąpienia od umowy i reklamacje

  1. Klient, będący konsumentem, ma prawo odstąpić od umowy sprzedaży zawartej na odległość w ciągu 14 dni od dnia otrzymania zamówienia, bez podania przyczyny, z zastrzeżeniem wyjątków przewidzianych przepisami prawa, w tym towarów personalizowanych oraz bielizny, które nie podlegają zwrotowi.
  2. W celu skorzystania z prawa odstąpienia od umowy, klient powinien złożyć stosowne oświadczenie na email: kaptureyt@gmail.com oraz zwrócić zamówione produkty w stanie niezmienionym, w oryginalnym opakowaniu, bez widocznych śladów użytkowania.
  3. Koszty zwrotu zamówionych produktów ponosi klient.
  4. W przypadku stwierdzenia wad produktu, klient ma prawo do złożenia reklamacji zgodnie z obowiązującymi przepisami prawa. Reklamacje należy składać drogą mailową na adres: kaptureyt@gmail.com. Sklep internetowy KAPTURE.PL zobowiązuje się rozpatrzyć reklamację w terminie 14 dni roboczych od dnia jej otrzymania.

§ 5 Postanowienia końcowe

  1. W sprawach nieuregulowanych niniejszym regulaminem mają zastosowanie przepisy prawa polskiego, w tym w szczególności Kodeks cywilny, ustawa o prawach konsumenta oraz ustawa o świadczeniu usług drogą elektroniczną.
  2. Sklep internetowy KAPTURE.PL zastrzega sobie prawo do zmiany niniejszego regulaminu w każdym czasie, z tym że do umów zawartych przed zmianą regulaminu zastosowanie mają postanowienia obowiązujące w chwili ich zawarcia.

These terms and conditions define the rules for using the online store available at www.kapture.pl, which is operated by Hubert Dziurzyński KAPTURE.PL, conducting business as a sole proprietorship registered in the Central Register and Information on Economic Activity, with its registered office at Gabrieli Zapolskiej 10B, 30-126 Kraków, holding NIP: 8691576071 and REGON: 122590346.
  2. The KAPTURE.PL online store operates in accordance with these terms and conditions and the applicable provisions of law, including, in particular, the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827, as amended) and the Act of July 18, 2002, on the provision of services by electronic means (Journal of Laws of 2002, No. 144, item 1204, as amended).
  3. To use the KAPTURE.PL online store, it is necessary to have access to the Internet and a device with a web browser that allows the display of web pages. The customer is obliged to use the online store in compliance with the law and the provisions of these terms and conditions.
  4. The online store provides services in the field of retail sale of products available on the website www.kapture.pl. All information regarding products, including their descriptions and prices, is binding from the moment the customer places an order.

§ 2 Placing Orders and Processing

  1. Orders can be placed in the KAPTURE.PL online store 24 hours a day, 7 days a week, via the form available on the website.
  2. The customer making a purchase in the KAPTURE.PL online store is required to provide accurate data necessary for the fulfillment of the order, including, in particular, the customer's name, delivery address, email address, and contact phone number.
  3. After placing an order, the KAPTURE.PL online store confirms its receipt by sending an email to the address provided by the customer in the order form.
  4. The KAPTURE.PL online store reserves the right to refuse to process an order in case of providing incorrect data by the customer, inability to contact the customer, or in other cases arising from the law.

§ 3 Payment Methods and Delivery

  1. The KAPTURE.PL online store allows payments for ordered products via electronic payment systems such as Przelewy24 and PayPal.
  2. Ordered products are delivered within the territory of the Republic of Poland by courier companies such as InPost. It is also possible to pick up the ordered products personally at the company’s registered office.
  3. Delivery costs are added to the price of the order in accordance with the price list available on the online store’s website and are borne by the customer.

§ 4 Right of Withdrawal and Complaints

  1. The customer, being a consumer, has the right to withdraw from the sales contract concluded remotely within 14 days from the date of receiving the order, without giving any reason, subject to exceptions provided by law, including personalized products and underwear, which are non-returnable.
  2. To exercise the right of withdrawal, the customer should submit an appropriate written declaration and return the ordered products in their original, unchanged condition, in their original packaging, without visible signs of use.
  3. The return shipping costs are borne by the customer.
  4. In case of product defects, the customer has the right to submit a complaint in accordance with the applicable legal provisions. Complaints should be submitted via email to: kaptureyt@gmail.com. The KAPTURE.PL online store undertakes to respond to the complaint within 14 business days from the date of its receipt.

§ 5 Final Provisions

  1. Matters not regulated by these terms and conditions are governed by Polish law, in particular the Civil Code, the Act on Consumer Rights, and the Act on the Provision of Electronic Services.
  2. The KAPTURE.PL online store reserves the right to amend these terms and conditions at any time, provided that for contracts concluded before the amendment, the provisions in effect at the time of their conclusion shall apply
